William Philip Schreiner (1857-1919) 'was [the first South African-born] prime minister of Cape Colony [1898-1900] at the outbreak of the South African War (1899-1902); he was the younger brother of author and political activist Olive Schreiner. A moderate politician, he tried to prevent the war and later was a champion of African civil rights' (Encyclopaedia Britannica online). Loosely inserted is a vintage cabinet card photograph (image size 150 x 105 mm, on the printed mount of the photographer James Bruton, Cape Town) of Schreiner and his wife, Frances Hester, nee Reitz. The ink inscription on the verso, 'Fan [sic] & Will, Jan 1884', would appear to be in Schreiner's hand. The mount has been unevenly trimmed along the bottom edge (well clear of the image itself), and there is a small tape stain near the top edge of the photograph and at the head of the title leaf, where the cabinet card had originally been attached. Both paper covers are loose; the paper on the back is wearing away; both flyleaves are heavily browned, the rest of the paper is of excellent quality) (Note: The first work 'On the abstention of eating flesh' is the most important work on ancient vegetarianism that has survived. In it Porphyrius tries to convince his friend Firmus Castricius to abstain from the eating of flesh of slaughtered animals at the official offerings to the Gods. It is a kind encyclopaedia of ancient vegetarian and anti vegetarian thought. The author is the Greek scholar and philosopher Porphyrius, 232/3 - ca. 305 A.D., who was more a polymath than an original thinker. In his numerous treatises and commentaries he has the good habit of quoting his sources by name. He thus presevered many fragments of older learnings. (OCD, 2nd ed. p. 864/65) Porphyrius was a student of Plotinus, whose Enneads he edited somewhere after 300. Most of his work is written from a Plotinian point of view. He produced also numerous philosophical commentaries on Plato, Aristotle, Theophrastus and Plotinus. His commentary on the Categories of Aristotle became a standard medieval textbook of logic. His philologic work include his 'Homeric Investigations', a landmark in the history of Homeric scholarship, and 'De antro Nympharum', a specimen of allogorizing interpretation. As for Plotinus, the aim of philosophy was for Porphyrius the communion with God, and an ascetic life was the way to achieve this. An important element of ascetism was the abstinence of eating flesh and killing animals for that purpose. The Greek philosopher Pythagoras, 6th century B.C., is considered to be the founder of vegetarianism. Membership to his order entailed inter alia a strict discipline of purity and the abstention from flesh. Many ancient vegetarians believed in the transmission of the human soul to other human beings, including animals. Others believed that eating flesh was injurious to the health of body and soul. For others a vegetarian lifestyle was preferable out of concern for animals themselves. Animals can suffer like humans, and therefore the use of violent and unnecessary killing of them ought to be avoided. 'Perhaps the most sophisticated grounds for ancient vegetarianism, however, are found in Porphyry. His argument (...) involves the claim that rationality is not a defensible criterion for receiving moral respect, because on this basis many members of our own species (the marginal cases of humanity, including the mentally defective) would not be protected. If we lowered the criterion for receiving moral respect to sentiency, so as to protect the marginal cases of humanity, we must, in order to be consistent, also protect sentient animals'. This edition of 'De abstinentia' was produced by the Dutch classical scholar Jacobus de Rhoer, born in 1723. He was a student of Peter Wesseling, professor of Greek of the University at Utrecht. In 1745 he became professor 'Historiae, Eloquentiae et Linguae Graecae' of the Athenaeum at Deventer. In his last years in Deventer De Rhoer produced this edition. It was dedicated to the 20 members of the City Council, for which dedication De Rhoer received 100 Ducates. In 1767 De Rhoer succeeded Van Lennnep as professor of Eloquence and Greek of the University at Groningen. (J.G. The basis for his edition was a manuscript from the collection of the Dutch book collector G. Meerman. (Praefatio p. This legal area is important for lawyer and citizen alike. The problems of prevention of harm and loss allocation are not only extremely diverse but also universal and fundamental. This traditional branch of law not only tackles questions which concern every lawyer, whatever is his legal expertise, but it also concerns on a worldwide scale each person's most fundamental rights, such as his right to bodily integrity, his right to a manworthy existence and his property rights. The way a legal system protects rights and interests through, among others, tort law co-determines the degree of civilisation and the development of a given society. However, no matter how fundamental tort issues may be, it is striking how the solutions offered in one system can be very different and sometimes quite diverse from those in another. There are basic differences in approach between the legal systems and the dividing line does not always match the classic divide between the countries of the Civil Law tradition and those belonging to the Common Law tradition. In the General Introduction, particular attention will be paid to the aims of the law of Torts and to the distinction between tort and crime and to the relationship between tort and contract (is concurrence between tortious liability and contractual responsibility permitted or not? what about precontractual liability?). For each country, the scope of protection will be tackled as well (are all interests equally protected?). The monograph is then divided into six Parts: Liability for One's Own Act; Liability for Acts of Others; Forms of Strict Liability; Defenses and Exemption Clauses; Causation; Remedies. Each Part in its turn is divided into Chapters. Thus, the first part devotes a chapter to Specific Cases of Liability, such as professional liability and liability of public bodies, abuse of rights and injury to reputation and privacy. The authors may feel free to add other specific cases which are peculiar to their legal system. The first chapter attempts to give a general overview of the 'delicate' concepts of fault and unlawfulness, duty of care and negligence, subjects on which civil and common law are on the same lines. The second part deals with the various cases of vicarious liability, liability of parents, teachers and instructors, as well as with liability for handicapped persons. It is possible to deal with liability for things and animals in a separate chapter. In Part III each national monograph will touch on the most important groups of cases in the area of strict liability, as for example a chapter on product liability, environmental liability and road and traffic accidents. If a legal system does not consider one of those groups as falling in the category of strict liability, it has to be signalled in each monograph and followed by a reference to the relevant chapter on this issue. The fourth part considers rules on limitations of recovery and grounds of justification like self help and consent. The fifth part about Causation will be confined to some general principles (concept, joint and several liability, interferences). Finally, the sixth part explains the major questions on remedies. The different types of damages, their assessment and compensation will be treated, with a special focus on personal injury and death. This part also discusses the role of private insurance and social security in each system.
